La tierra de la libertad, de los derechos, de la dignidad del ser humano, y el burka



En Francia ha surgido un debate acerca de si se debe permitir o no el uso del burka en lugares públicos. Reconozco que éste es un tema apasionante para todos aquellos que nos preguntamos acerca de dónde acaban los poderes del Estado frente al individuo.

Cuando hace años surgió el tema del velo en las aulas francesas, mi postura fue que se debía permitir. ¿Qué es lo que debe permitir el Estado? La respuesta es que el Gobierno, el Senado, el Congreso, no están aquí para permitir lo que les apetezca. Hay que permitirlo todo, guste o no guste. El Estado sólo y únicamente puede cohibir la libertad personal en aquellas acciones que de un modo objetivo provoquen un perjuicio para otros. Evidentemente, el velo no perjudicaba a nadie. Allí el Gobierno quiso imponer su posición ideológica en un tema opinable.

La cuestión no es ¿qué debe permitir el Estado? Sino que lo que debe entender el Estado es que no puede prohibir lo que le dé la gana.

Ahora bien, el tema del burka es distinto. Todo el mundo comprende que haya quien quiera llevar un velo, pero también todos comprendemos que nadie deber querer enterrarse bajo un burka.

Aquí ya no estamos hablando de un signo religioso o de una ropa de vestir. El burka no es una prenda sin más, es una opresión, un yugo. Ningún ser humano merece que se le ponga encima eso todos los días al salir a la calle. Eso no es religión, es la deformación de la religión.

Imaginemos que mañana hay una secta que impone a sus familias cortarse el dedo meñique. Eso no podría ampararse bajo las leyes de libertad religiosa. Entre la circuncisión y la ablación hay una diferencia sustancial, entre el velo islámico y el burka hay una diferencia sustancial.

Los gobernantes deben hacer lo posible para fomentar lo bueno, y evitar que se extienda lo que es objetivamente malo. Moralmente hablando no sólo no veo ningún reparo moral en que el burka se prohíba en determinados espacios públicos, sino que además considero que el Estado debe hacerlo y no quedarse como testigo mudo ante la extensión de algo que atenta a la dignidad de la mujer.

In France a debate has arisen if it is necessary to allow or not the use of the burka in public places. I admit that this is an exciting topic for all those that we wonder about where they finish the powers of the State opposite to the individual.

When years ago the topic of the veil arose in the French classrooms, my position was that it had to allow. What is what must allow the State? The answer is that the Government, the Senate, the Congress, they are not here to allow for what it longs to them. It is necessary to allow everything, please or do not please. The State only and only can cohibir the personal freedom in those actions that in an objective way provoke a damage for others. Obviously, the veil was not harming anybody. There the Government wanted to impose his ideological position in a topic opinable.

The question is not: what must allow the State? But what must understand the State is that it cannot prohibit what gives him the desire.

Now then, the topic of the burka is different. The whole world comprises that there is the one who wants to take a veil, but also we all comprise that nobody to have to want to be buried under a burka.

Here we are not already speaking about a religious sign or about clothes of dressing. The burka is not a pledge without much ado, it is an oppression, a yoke. No human being deserves that every day puts above his that on having gone out to the street. This is not a religion, it is the distortion of the religion.

Let's imagine that tomorrow there is a sect that imposes on his families the little finger is cut. That might not seek protection under the freedom of religion laws. Between the circumcision and the ablation there is a substantial difference, between the Islamic veil and the burka there is a substantial difference.

The leaders must do all the possible to encourage the good thing, and to prevent from spreading what is objectively bad. Morally speaking not only I do not see any moral objection in which the burka is prohibited in certain public spaces, but also I think that the State must do it and not remain like mute witness before the extension of anything that commits an outrage against the dignity of the woman.
